We have a house we are selling in Phippsburg,ME. The buyers bank says there is a problem with ownership on the title. Our Aunt was born in the house some 140 years ago. Her parents lived in the house with her mothers sister (the owner of the house). The house was left to our Aunt who died at the age of 103 and deeded the house to My Grandmother who deeded it to her daughters in 1996. The question is How far back must a buyers bank show a clear title? This house shows clear title back as far as there are records in this town some 140 years. How can they see a problem with a title that has been in our family for 225 years. That''s how old the house is?

The broker has brought this information to us this past Friday. I told my mother and her sisiters that they should hire their own title company to do a search. The buyer has signed a no- contingincy contract. I heard today she is trying to renegotiate the contract now.

Getting your title research done is a good step. Most title insurance companies want a clear title as far back as they can search. You should ask for a specific list of the issues the bank has found and see if you can clarify the issues and get the title cleared, if it actually needs it. Do not renegotiate the contract until you find out that you must do so to sell it, because if you do have clear title or you can clear it rather quickly the buyer has no leverage to force you to renegotiate.
