Jeweler did not follow instructions for making of wedding rings. Did not make and get approval of wax ptototype for customer as agreed. Jeweler was given three rings (one each belonging to our deceased fathers to make our wedding bands and one more from which only the diamonds were to be removed. The jeweler melted all three rings together (one of which was from a previous marriage and was made very clear that only the diamonds were to be used from this ring and the gold returned to customer. Should I have to pay for this as the contract was not followed? I want the rings back as they contain the gold from our Fathers rings. Please advise, our wedding date is very near and I'm unsure of what I should do.

I spoke with Jeweler. He wants me to pay at least half of what the original agreed cost was for labor. I am so not in agreement with that.

A breach of contract terms occurs when the terms of the contract are not followed according to the terms. If the instructions were clear as to what he was supposed to do, then failure to perform accordingly is a breach of contract. If the jeweler is not willing to return the rings without payment, then your only option would be to sue him for its return. The only problem with this would how soon you can get your case heard as most courts in California may be back logged.
